General overview

The REACH-regulation 1907/2006/EC replaced Directive 67/548/EEC and their amendments. Whereas there were no testing or notification obligations for existing (EINECS-listed) substances in the past, the new legislation requires a data set and registration also for those chemicals. EINECS-listed substances had to be pre-registered between 1 June and 1 December 2008 in order to continue their production or import in future. ELINCS-notified chemicals can be considered as registered under REACH.

As of 1 June 2008, the notification scheme has been revoked and replaced by the Regulation (EC) No 1907/2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH, OJ L 396, 30.12.2006). REACH is managed by the European Chemicals Agency (ECHA) in Helsinki.

The REACH regulation applies to substances manufactured in, or imported to the EU in annual quantities of 1 ton or more per importer or manufacturer. Quantities below 1 tpa are exempt from registration.

Existing Substances
More than 100’000 existing chemicals (EINECS-listed = Phase-In substances) have been in use before REACH came into force. In order to continue production or import in future, these chemicals had to be pre-registered between 1 June and 1 December 2008. Companies that have pre-registered their substances can benefit from the staggered registration deadlines (2010, 2013 or 2018) for their substances:

30 November 2010:
- Substances > 1000 t/year
- CMR-substances Cat.1/2 > 1 t/year
(CMR = Carcinogenic, mutagenic, toxic for reproduction)
- N-R50/53-substances > 100 t/year

31 May 2013:

- Substances 100-1000 t/year

31 May 2018:
- Substances 1-100 t/year)

If a company has failed to pre-register, further sales will be prohibited immediately until a complete registration dossier will be submitted. The compilation of such a dossier would require approx. 10 months for a tonnage band of 1-10 tpa.

New Substances

New substances require immediate registration BEFORE they are produced in or imported into the EU in amounts of more than 1 tpa.

ELINCS-Notified Substances
Chemicals already notified according to the former European Chemical Legislation Directive 92/32/EEC are considered as registered under REACH. The ELINCS-number was replaced by a new REACH-Registration-Number.

Lonza’s approach

Risk assessment and Chemical Safety Report (CSR) are key steps in the REACH process of
substance registration. Therefore all producers and importers of chemicals have to perform a safety evaluation for all the chemicals produced above 10 tons per year and for all intended downstream uses/applications. A use/application not included in the CSR will not be in compliance with the regulation.

As part of the on going preparation for REACH, Lonza is already developing information on uses. This will result in a list that includes all known uses per substance. The list will then be made available to Lonza’s customer.

For Lonza substances with a registration deadline of 30 November 2010 and 30 May 2013 the list will be distributed at the beginning of 2010. For substances with the registration deadline in 2018 the same approach will apply at a later stage.
